Our website uses Shariff, a project of c't magazine. "Shariff" replaces the usual share buttons for social networks, thereby keeping your online behavior private. We will not forward your data to third countries or to any international organizations. “Third countries” refers either to countries outside the EU or countries with a lower level of data protection than the EU.

Duration and basis of data storage:

Your personal data will be stored for at least six months. The basis for this is Section 61b of the ArbGG (Labour Court Act) based on claims under Section 15 AGG (German General Equal Treatment Act). If we believe that we could potentially be able to offer a suitable job in the six months following the initial period, we will ask your consent to store your data for a total of twelve months after receipt of the application. In order to assert or defend legal claims, the storage period may potentially be extended by the duration of the retention period in the context of the proceedings.

Statutory obligation to provide data:

There is no statutory obligation to provide data on your part.

If a contractual relationship exists between the PROTEMA Group and you or your employer, we will additionally store your data on the establishment of contact, communication, and billing in the context of this contractual relationship. The legal basis for processing is Art. 6 Para. 1 b) GDPR (if you are self-employed) / Art. 6 Para. 1 f) GDPR (if you are in an employment relationship).

If the processing of your data is based on Art. 6 Para. 1 f) GDPR, you can object to data processing at any time with future effect. We will then halt the processing of your data unless we can prove the existence of mandatory grounds for continued processing that are worthy of protection pursuant to statutory requirements that take precedence over your rights. If you are our contract person for billing, your data will be shared with our tax office and accounting department. If necessary, the data will be shared with external service providers if you encounter our security service in the facilities of the PROTEMA Group or submit a false alarm. We will also grant access to your personal data as needed in the context of audits. If a statutory obligation to do so exists, we will share your data with authorities.

Your data will be stored for ten years after termination of the business relationship. The basis for this is the requirements of financial and tax law. If your data is collected by our security service because you were encountered in the facilities of the PROTEMA Group, this data will be stored for three months. In the event of a submission of a false alarm, the data collected will be stored for five years. In order to assert or defend legal claims, the storage period may potentially be extended by the duration of the retention period in the context of the proceedings.

Purpose and legal basis for the processing:

The PROTEMA Group stores your personal data in order to be able to contact you in the context of concluded, existing, or planned contracts or to be able to perform the contractually agreed service. The legal basis for this is Art. 6 Para. 1 f) GDPR.

If the processing of your data is based on Art. 6 Para. 1 f) GDPR, you can object to data processing at any time with future effect. We will then halt the processing of your data unless we can prove the existence of mandatory grounds for continued processing that are worthy of protection pursuant to statutory requirements that take precedence over your rights. Categories of recipients of data:

Your data will only be processed within the PROTEMA Group. When this occurs, the data will only be made available to selected employees. If you are our contract person for billing, your data will be shared with our tax office and accounting department. If necessary, the data will be shared with external service providers if you encounter our security service in the facilities of the PROTEMA Group or submit a false alarm. We will also grant access to your personal data as needed in the context of audits. If a statutory obligation to do so exists, we will share your data with authorities.

Transmission of data:

We will not forward your data to third countries or to any international organizations. “Third countries” refers either to countries outside the EU or countries with a lower level of data protection than the EU. If the PROTEMA Group employs the services of third parties domiciled outside the EU in the context of your project, then the PROTEMA Group shall be in possession of the corresponding data protection guarantees.

Duration and basis of data storage:

Your data will be stored for ten years after termination of the business relationship. The basis for this is the requirements of financial and tax law. If your data is collected by our security service because you were encountered in the facilities of the PROTEMA Group, this data will be stored for three months. In the event of a submission of a false alarm, the data collected will be stored for five years. In order to assert or defend legal claims, the storage period may potentially be extended by the duration of the retention period in the context of the proceedings.

Statutory obligation to provide data:

There is no statutory obligation to provide data on your part.

You possess various rights by law:

  • We must provide you with information on your stored data (Art. 15 GDPR).

  • We must correct your data if it should prove incorrect (Art. 16 GDPR).

  • We must delete your data if you request that it be deleted and if doing so is legally permissible (Art. 17 GDPR).

  • Subject to certain preconditions, we must restrict the processing of your data. You must contact us for this purpose accordingly (Art. 18 GDPR).

  • You can lodge an objection to the use of your data. We will then no longer be permitted to use your data for the specified purpose (Art. 21 GDPR).

  • You can transfer your data from us to another provider (Art. 20 GDPR).

  • You can withdraw your consent to our processing of your data. We will then no longer be permitted to use your data in the future (Art. 7 Para. 3 GDPR).

Purpose and legal basis for the processing:

PROTEMA Group processes your personal data (recordings from video-monitored areas) for the purpose of exercising domiciliary rights and preventing theft and vandalism. The legal basis for this is Art. 6 Para. 1 f) GDPR and §4 BDSG.

With the video surveillance of buildings and property, the PROTEMA Group pursues the legitimate interests of prosecuting criminal offences and protecting property. Workplaces and rooms for the predominantly private lifestyle of employees are not monitored.

If the processing of your data is based on Art. 6 Para. 1 f) GDPR, you can object to data processing at any time with future effect. We will then halt the processing of your data unless we can prove the existence of mandatory grounds for continued processing that are worthy of protection pursuant to statutory requirements that take precedence over your rights. The video surveillance recordings are regularly overwritten; complete deletion takes place after 10 working days at the latest.

For the assertion or defense of legal claims or the prosecution of criminal offenses, the storage period is extended, if necessary, for the duration of the retention period in the proceedings.
